Local Law 126 Failure-to-File Violations in Manhattan

A failure-to-file violation means DOB has no accepted Local Law 126 report for your Manhattan garage, and the penalties grow every month it stays that way. We bring in a licensed QPSI partner to complete the overdue report, protect anything the engineer finds unsafe, and walk you through clearing and paying the violation once the filing is accepted.

What Is a Local Law 126 Failure-to-File Violation in Manhattan?

How We Help Clear a Manhattan Garage Violation

One team handles the engineer, the paperwork and the repairs, so nothing waits on someone else.

Violation and Record Review

We read the DOB notice and the garage record in DOB NOW to see every open violation and missing filing.

QPSI Report Booked Right Away

A licensed QPSI partner is scheduled for the overdue condition assessment, the step that stops the monthly penalty.

Protection and Urgent Repairs

If the assessment turns up Unsafe conditions, our crews put protection in place and start the repairs.

Payment and Waiver Support

We help you line up the accepted report, the penalty payment and any waiver request in the right order.

Why Manhattan Garages Ended Up With a Violation

01

The garage changed owners or managing agents, and the filing fell between them.

02

The owner assumed the parking operator was handling the inspection under the lease.

03

A QPSI walked the garage, but the report was never filed or came in after its deadline.

04

The building’s garage was missed because it sits under a commercial or mixed-use property.

05

An Upper Manhattan or Upper East Side garage skipped the separate observation report DOB required.

Clearing a Local Law 126 Violation Step by Step

These five steps, in this order, take a Manhattan garage from an open violation to a closed file.

1. Look Up the Violation

Search the garage in DOB NOW by address, BIN or violation number to confirm what DOB has issued.

2. Book the Condition Assessment

Have a QPSI inspect the garage and submit an acceptable report in DOB NOW, which ends the late filing penalty.

3. Deal With Any Unsafe Findings

4. Pay or Request a Waiver

Once the report is accepted, settle the penalties in DOB NOW, or ask for a waiver if the garage was exempt.

5. Keep the Garage Current

Start the yearly observations and track every SREM date so no new violation follows.

Our Process for Manhattan Violation Cases

01

Read the Notice

We confirm the violation type, the date it started and every other open item on the garage.

02

Get the Report Moving

A QPSI partner is booked and the garage is cleared for the assessment as soon as dates allow.

03

Fix What Cannot Wait

Unsafe conditions are protected and repaired first, then the rest of the report is priced and phased.

04

Close It Out

Dated photos and repair records go to the QPSI for amended filings, and we help you settle the penalties.

Manhattan Violation Rules That Depend on Your District

Community Districts 1 to 7

Lower Manhattan, Midtown and the Upper West Side had the earliest deadline in the city and received the first failure-to-file violations. These garages were not required to file the separate observation report, so the full condition report is the only filing that clears them.

Community Districts 8 to 12

Garages on the Upper East Side and in Upper Manhattan had a second filing to watch. After the Ann Street garage collapse in Lower Manhattan, DOB required them to file an observation report early unless a full report was already in. Missing it brings an OATH violation with its own hearing, separate from the DOB failure-to-file violation.

What Clearing a Manhattan Garage Violation Can Cost

The final bill depends less on the violation itself and more on these five things.

Months Without a Report

The late filing penalty runs every month until DOB accepts a report, so time is the biggest cost.

Years Past the Deadline

Once a full year passes without a report, a yearly failure-to-file penalty is added on top.

DOB Filing Fees

The initial filing fee and, in some cases, a separate fee for an inspection forced by the missed filing.

What the Assessment Finds

Unsafe conditions bring protection, urgent repairs and an amended filing into the scope.

Size and Condition of the Garage

Big, older garages need more time to assess and usually come back with more conditions to repair.

The Right Order From Day One

We start with the step that stops the penalty, not with paperwork that cannot be accepted yet.

Straight Answers on Penalties

Failure-to-File Violation FAQs for Manhattan Garage Owners

Under DOB’s fee and penalty schedule for parking structures, the owner owes $1,000 each month the initial report remains missing, starting the day after the filing period ends. If no report is filed at all, a $5,000 a year failure-to-file penalty applies as well.

The late filing penalty stops counting once DOB accepts the condition report. Penalties already charged stay on the record and still have to be paid or waived.

No. DOB will not process a penalty payment on these violations until it has accepted a report, so the QPSI assessment always comes first.

Through DOB NOW Safety, under Violations, then Violations Payments and Parking Structures. Each application covers one violation. DOB takes eCheck, credit card, PayPal or Venmo, with a 2 percent surcharge on the last three, and does not take payment in person or by mail.

Ask DOB to drop the penalties through a Waiver of Civil Penalties filing in DOB NOW with proof of the exemption, or email DOB’s parking structures unit with the violation number, the address and the evidence. The waiver request carries a $140 fee. Exempt garages include those with fewer than three spaces and buildings whose first certificate of occupancy came less than six years before the filing deadline.

Because DOB required an early observation report from Manhattan Community Districts 8 to 12 by August 1, 2024, unless a full report had already been filed. Districts 1 to 7 were not part of that rule. Missing it brings an OATH violation with a hearing date.

Yes, until DOB accepts a report. The QPSI has to correct and resubmit it, and the late filing penalty keeps running in the meantime, so a quick fix matters.

DOB violations are tied to the property record, so an open failure-to-file violation can still sit on the garage after a sale. Check DOB NOW before closing and talk with your attorney about who covers the filing and the penalties.

Call (917) 355-8556 or upload the violation and any past report with the form below. After checking the garage in DOB NOW, we line up an engineer and send the clearing steps in the order they need to happen.
